Handling W-8BEN Forms with US Addresses for Foreign Vendors

Q. We received a W8Ben form and line 4 is a US address. We have returned the form to the vendor and indicate we cannot accept W8Ben's permanent address is a US address. The vendor claims citizenship of India and indicates he does not have an Indian address as a permanent address. If the vendor insists he only has a US address, what is the proper way to handle this? We do have item that need to withhold 30% taxes. How will it affect us to issue a 1042 if the vendor insists he only has US address…
