Perhaps the most utilized form in the IRS reporting program, completing 1099-MISC for certain payments can be a daunting task. Due to recent developments with new and proposed legislation, compliance with regulatory procedures, withholding and filing is crucial to your organization. HR Bill 3408 which is now in the House of Representatives proposes that the exclusion to not report on payments issued to corporations be eliminated and those payments deemed reportable, which will require compliance with TIN Certifications, Backup Withholding, and Information Returns.
Additionally HR 3408 proposes that the current Penalty Structure be raised up to five times or more the current levels beginning with Information Returns filed for tax year 2009. The corporate reporting proposal was actually passed several weeks ago by the house and is now in the Senate for approval. Change and enforcement are on a fast track with the IRS and with the initiatives for audits of all information reporting and withholding, organizations that are not knowledgeable and do not comply with current or new regulations can be at serious financial risk for penalties, interest and withholding.
If HR 3408 is passed, most organizations will see significant increases in documenting, certifying, backup withholding, reporting, B-Notices (CP2100) and most importantly the Penalty Assessment (IRS 972CG).
