Notification of a B-Notice (CP2100 or CP2100A) is the first step in which the IRS notifies you that you have issued and reported payments to the IRS and that include incorrect payee information that does not match the IRS or SSA databases. As a payer you are REQUIRED to take action. Additionally, the B-Notice is your opportunity to reduce or eliminate penalty exposure that will be sent to you on The TIN Penalty Notice (972CG) at a future date.

With the increased scrutiny that the IRS has placed on requests for abatement and the enforcement of the regulations, ignoring notices or not demonstrating due diligence by complying with the regulatory procedures that a payer is required to follow can place your company at risk for costly penalties.

Additionally, there is a proposal in the House of Representatives to eliminate the exclusion for reporting payments issued to corporations and to increase the current penalty amounts up to five (5) times the current amounts. Passage of this bill (which many say is likely) could significantly increase the number of 1099's you will be required to report, thereby increasing B-Notices and penalties. With the proposed increase in penalty amounts, your company's exposure could be significant.

It is now more important than ever to focus on your procedures and improve communication with your payees.
